General conditions on subscription and payment for a Chocolate Masterclass

  1. General
    1. These conditions apply to all online registrations for a House of Chocolate (HOC) Masterclass. Every registration implies the explicit acceptance of these conditions.
  2. Subscription
    1. For practical and organizational reasons CARGILL NV can decide on a maximum number of participants. Registration shall only be possible when the maximum number of participants has not yet been reached.
    2. Every Masterclass will be organized on the indicated date and place, mentioned on the HOC-website. CARGILL NV is not responsible for unforeseen events.
    3. CARGILL NV reserves its rights to postpone a Masterclass or to make minor alterations to the content and timing of the program or to the identity of the trainers/chefs. In exceptional circumstances CARGILL NV can also cancel a Masterclass, by refunding the participants who already paid and registered. CARGILL NV will not, however, be held responsible for reimbursement of any additional costs, expenses or claimed damages.
  3. Price
    1. CARGILL NV does its utmost to ensure that all pricing information on the website is accurate, but cannot guarantee the absolute absence of error. In the event that an error in the price of a Masterclass shall occur, CARGILL NV shall give participants the option to (1) confirm the purchase of the Masterclass at the correct price or (2) to cancel the order. If CARGILL NV is not able to contact the customer within 30 days, the order will be treated as cancelled.
    2. CARGILL NV reserves the right to amend any and all errors or inaccuracies, even after an order has been submitted and furthermore reserves the right to amend or modify the information on the HOC website at any time without any prior communication.
    3. The price, as mentioned on the HOC website includes the class, the materials it requires, and -if applicable for the specific Masterclass- one lunch. It does not include air travel, local transportation costs, meals other than one lunch (if applicable) during a class day, nor does it include any cost of accommodation or any other potential or actual cost of the participant.
    4. Participants are responsible for making their own travel arrangements and hotel reservations.
  4. Right of revocation
    1. In case of an online subscription to a Masterclass, the participant has the right to inform CARGILL NV that he/she has decided not to go ahead with the purchase, without payment of a fine and without indication of a reason, within 14 working days from the day following the day of official subscription, with full and final payment of the price.
  5. Complaints or disputes
    1. Complaints or disputes should be made known within 14 days after the Masterclass, and must be made in writing. If the complaint is found to be grounded, the liability of CARGILL NV is limited to the actual price paid for the Masterclass.
  6. Liability
    1. CARGILL NV shall not accept liability for inaccurate information provided by the customer.
    2. CARGILL NV shall not accept liability if payment is refused or declined by a credit/debit card supplier or another bank facility for any reason.
    3. CARGILL NV shall take no responsibility for and will not be liable for the website being temporarily unavailable due to technical issues beyond its control or the online payment facility being temporarily unavailable due to technical issues beyond its control.
    4. In no event will CARGILL NV be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from participant’s use of the online payment facility.
  7. Invoices
    1. SMET CHOCOLATERIE BV shall be the sole beneficiary of all online payments. SMET CHOCOLATERIE BV is an affiliate of CARGILL NV, entrusted with the practical organization of the HOC Masterclasses. Participants shall receive the corresponding invoice, issued by SMET CHOCOLATERIE BV, in due time after the online registration, together with a payment confirmation, where applicable.
    2. In the event of overdue payments, interest shall be added to the outstanding amounts on the invoice by order of law and without prior notice of default at a rate of 1% per months as of the invoice date. In case of non-payment and if a demand by ordinary post is not responded to within 14 days, fixed compensation to the value of 10% of the outstanding amount with a minimum of € 50 (fifty euro) will be due.
  8. Data processing
    1. The data that participants provide during the registration and the online payment transaction is securely held by CARGILL NV under the terms of the GDPR and in accordance with our privacy policy and will only be used for the purpose of recording your payment and for accounting processes.
    2. By using the online payment facility, participants are agreeing to share their data with the online payment facility provider, according to the terms and conditions of this specific provider.
  9. Applicable legislation
    1. Belgian law applies to these conditions and any disputes will be referred to the competent district court of Antwerp.
